Terms and conditions

The ground rules for working with Franchise Marketing Bureau, in plain language.

This English translation is provided for convenience; the Dutch version is legally binding. These terms and conditions apply to all quotes, assignments and services of Franchise Marketing Bureau, St Jacobsstraat 123-135, 3511 BP Utrecht. Anything stated in a signed quote takes precedence over this general text. If you have a question about an agreement, please contact us first.

When do these terms and conditions apply?

The terms and conditions apply as soon as you accept a quote from us or give us an assignment. Any deviations are agreed in writing, usually in the quote itself. The client's own general terms and conditions only apply if we have expressly agreed to them.

Steps of an assignment under the terms and conditions of Franchise Marketing Bureau: quote, delivery and agreements on data
The quote sets out price, term and notice period in writing in advance.

How do we handle quotes and prices?

All prices are exclusive of VAT. The fixed prices per location per month are publicly listed on our pricing page. For bespoke work, such as social media, recruitment, SEO or ad management, we draw up a fixed quote. Strategy, advice and training are charged by the hour, following a fixed quote in advance. A quote is valid for the period stated on it.

We do not work with annual contracts. The term and notice period are stated in the quote; an agreement is not tacitly renewed for a year.

How do we carry out an assignment?

We work according to our working method: scan, pilot, roll-out and monthly optimisation. We do our best to achieve the agreed goals, but rankings in search engines, map services and AI assistants are determined by those platforms. That is why we promise effort and transparency, not a guaranteed ranking. You pay advertising budget directly to the platform. The term and notice period of an assignment are stated in the quote.

What do we agree on data and rights?

Accounts, profiles and advertising accounts remain the property of the franchise brand. We receive management rights for the duration of the assignment. Texts and materials we create for you may continue to be used by you after payment. We treat all information we receive from you confidentially. Questions about these terms? See how to get in touch for ways to reach us.

Where can you find more information besides these terms?

These terms do not stand apart from the rest of the website. How we handle data is explained in our privacy statement, and which cookies we place is set out in a separate statement. Prices and packages can be found under pricing and packages; how a partnership works is explained step by step. If you have a question about a provision, see our contact details.

Questions about the terms and conditions

Does the quote take precedence over the terms and conditions?
Yes. If the signed quote says something different from these terms and conditions, the quote applies. This allows us to make agreements per franchise brand that suit the number of locations, the term and the services you purchase.
Are the prices inclusive or exclusive of VAT?
All prices stated are exclusive of VAT, including the fixed prices per location, the hourly rates and quotes. VAT is shown separately on the invoice. Advertising budget falls outside our prices, because you pay it directly to the platform.
Do you guarantee a particular position in Google or Maps?
No. Search engines, map services and AI assistants decide for themselves which results they show. Nobody can promise a fixed position. What we do promise is a consistent approach, clear agreements and an honest dashboard in which you can see per location what is changing.
Who owns the Google Business Profiles during and after the assignment?
The profiles and accounts remain the property of the franchise brand or the location. We receive management rights for as long as the assignment runs. If the partnership ends, we hand over management properly, so you can continue with your profiles without interruption.
What is the notice period for an assignment?
The term and notice period are stated in the quote you sign. A pilot always has a fixed period. Once it ends, we agree together how to proceed. That way you know exactly in advance what you are committing to.
May I use the texts you write myself later on?
Yes. Texts, pages and materials we create for your franchise brand may continue to be used by you after payment, even if the partnership ends. Third-party work, such as stock images or tools with their own licence, is subject to that party's terms.
How do you handle confidential information about the franchise brand?
Everything we learn about your franchise brand, locations and figures is treated confidentially. We only share it with people in the team or regular freelancers who work on it. On request, we sign a separate non-disclosure agreement.
What happens if a payment is late?
We first send a friendly reminder. If payment is still not made, we get in touch to find a solution together. As a last resort, we may pause work until payment has been received. We always discuss this with you first.
Can I submit a complaint about the delivery?
Yes. Report your complaint as soon as possible by email, with a short description. We respond within our opening hours and look for a solution together. Most problems can be resolved with a conversation and a concrete adjustment.
Which law applies to our agreements?
Dutch law applies to all agreements with Franchise Marketing Bureau. We always try to resolve disputes together first. If that does not work, the competent court in the Netherlands may decide on the matter.
